The house is five minutes south of Jamaica Beach, Texas, which is one of the most popular beach towns and sought-after private neighborhoods for beach vacation rentals. Jamaica Beach is far enough away from the hustle and bustle of Galveston but still a quick drive to the island’s historic strand shopping, food, and attractions. The house boasts an open concept floor plan, natural light and views of the ocean from anywhere in the house. Let your troubles melt away at Magnolia Beach!

The entire home was recently renovated and provides the perfect location for your beach vacation with the whole family, friends, and children of all ages. Enjoy two spacious bedrooms with en-suite full bathrooms and a conveniently located third full bathroom off the living room, which is perfect for extra guests. Every room is designed with our guests in mind. We provide all the comforts of home including paper towels, soap, dishwasher soap, and laundry cubes - just bring your swimsuit!

The neighborhood is car and golf carts friendly. Golf carts can be rented from the shop across the street.

  • •   RENTAL AGREEMENT RESERVATION ADDITIONAL TERMS, POLICIES, AND CONDITIONS By booking this reservation of the vacation rental property, the person who is the responsible primary Guest (“Primary Guest” or “Responsible Guest”) of the property, which is located at 17713 Termini-San Luis Pass Rd., Galveston, TX 77554 (“Property”) hereby reads, understands, and agrees to be legally bound by the Additional Terms, Policies, and Conditions (“Terms”) listed below. These Terms are between: (1) The owner of the Property (“Owner”), and (2) the Guest and apply to a reservation confirmed by the owner directly or third-party booking website. In case of any conflict between these Terms and the third-party booking website terms (“Booking Terms”) that apply to the Guest’s reservation, the Agreement will control. GENERAL TERMS •Minimum Age. The “Minimum Age” to rent the Property is the age specified in the Booking Terms. If no age is specified the Minimum Age is 21 years of age (or the minimum age required by law in the jurisdiction where the Property is located, if different). Guest agrees to provide us with proof of age upon request. A parent or legal guardian must accompany all guests who are under the Minimum Age for the entire duration of the rental. •Maximum Occupancy. The number of people present at the Property may not exceed eight (8) total people (adults and children). No unregistered guests are allowed in or on the Property. Registered guests must be disclosed during the reservation or by written consent of the Owner. If maximum occupancy is exceeded the Owner reserves the right to ask certain or all guest(s) to vacate the property pursuant to the Eviction and Removal of Guest(s) policy included herein. •No Third-Party Booking: No Primary Guest may rent the property on behalf of other guests or occupants. The Primary Guest must be present for the duration of the reservation. If the responsible primary Guest is not present, all other authorized and/or unauthorized guests or occupants will be asked by the Owner (or booking agency representative) to vacate the property pursuant to the Eviction and Removal of Guest(s) policy included herein. •Conduct: Guest and other Occupants agree to conduct their selves throughout the stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to the Owner from police, fire department, neighbors, and/or the homeowner association. •No Permanent Residence. Guest agrees that use of the Property is on a temporary and transient basis only; that Guest may not use the Property as a permanent residence; and that the Guest other Occupant permanent residence is and will remain elsewhere than at the Property. Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement. •Animals. Unless given specific written consent by the Owner, no animals or pets of any kind are permitted at the Property. If any unauthorized pets are found or discovered to be property the Guest (primary, authorized, and/or unauthorized) and any other occupant will be asked by the Owner to vacate the property pursuant to the Eviction and Removal of Guest(s) policy included herein. No refund or waiver of cancellation fees will be granted. The Primary Guest will be responsible for any property or amenity damage caused by authorized or unauthorized pets. Fees for damage will be charged to the card used during the direct or third-party booking process. The Guest agree that the Owner cannot and does not guarantee that no animals have been in the Property prior to Guest’s use or that the Property is free of animal or pet allergens, even if the Property listing states that pets are prohibited or includes a similar description. •Criminal Activity Prohibited. Use of the Property for any criminal activity, deemed by the local, state, and federal laws governing the location of the Property, is prohibited and may result in fines, prosecution, and/or Guest or Other Occupants immediate removal from the Property. •Car Ports: For the safety of guests and our neighbors, parking vehicles, boats, or any other motorized equipment in the car ports located under the Property is strictly prohibited. •Early Check-in and Late Check-Out: Early check-in or late check is prohibited unless given written owner consent. •Food and Beverages: To avoid food and beverage stains, please do not eat or drink in the bedrooms. •Toiletries: Please do not flush or place anything synthetic down the toilets or drains. This includes but is not limited to, tampons, wet wipes, any bacterial wipes, paper toilets, napkins and wrappers of any sort. The sewage system is unable to cope. •Furnishings: Please do not rearrange furnishings. All furnishings should be left in the manner they were found in at check-in. •Trash: A dumpster is available at the south end of the property. Guest shall take out trash to the dumpster as needed and after confirmed reservation. •Smoking and Illegal Substances: Smoking or illegal substance use, of any kind, is permitted anywhere on the Property or Homeowner Association premises. •Events and Parties: Unless given written consent from the Owner, events, parties, gatherings, and charcoal grills are prohibited at the Property. For the safety of the Guests, property, our neighbors, and the greater homeowner’s community the property is equipped with a video recording doorbell and an interior, non-recording, noise detection device. The owner reserves the right to use this equipment to enforce the no event or party policy. If a party is found to be occurring, all Guests (Primary, authorized, or unauthorized) and/or other occupants will be asked to vacate the property pursuant to the Eviction and Removal of Guest(s) policy included herein. •Commercial Photography and Filming: Unless given written consent by the owner, commercial photography and filing are prohibited at the Property. •Structures: No tents or other structure may be erected on the Property or within the community property owned and maintained by the Property’s Homeowner Association. •Damages: Should damage occur during occupancy the Guest agrees to charges, above and beyond any security deposit collected during booking, for repair or replacement of damage done to the Property, appliances, linens, furnishings, and all other items located in the Property. Charges will be placed on the form of payment used during the reservation and booking process. All charges will be in compliance with the booking agency or direct booking site policies. oThe Property is provided as is, and Owner is not responsible for the inoperability or unavailability of any amenities. Guest agrees to contact Owner using the contact information provided in the booking confirmation email, as soon as the Guest or other Occupants notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. Guest further agrees to give Owner a reasonable amount of time to respond to the report and to cooperate with Owner’s efforts to address the concern or provide a remedy. The Owner will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. The Owner or professional hired by the Owner may enter the Property at the Guest’s invitation to remedy any problem reported, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property. oGuest, and all other guests, acknowledges that use of amenities such as fireplaces, decks, appliances, outdoor grill, stairs and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk. •Substitution of Property. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of the confirmed reservation and Owner may have to cancel the booking. In this unlikely event, rebooking shall be subject to direct or third-party Terms for booking modifications. •Entry and Inspection: Owner, and its designee(s), reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, Guests, or other authorized persons. If Owner has a reasonable belief that there is imminent danger to any person or property, Owner may enter the Property without advance notice. ENFORCEMENT OF TERMS, POLICIES, AND CONDITIONS •Consequences of Breach; Charges for Damage. Any failure by Guest or any other Occupants to comply with any of the terms, conditions, or policies above is a breach of these Terms and may result in a forfeiture of their rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement. In addition, subject to the Booking Terms, damage claim policies, the Guests are responsible for (1) any damage or loss that occurs at the Property during the stay; (2) a charge of up to $1,000 for violations of the pet policy, including for bringing pets authorized; (3) an additional cleaning fee of up to $500 (or the actual cost of cleaning services, if greater) for violations of any of the guest policies above (other than the pet policy) or for excessive cleaning required by the acts or omissions of any Occupant during the stay; and (4) any fines issued by police, other government officials or agencies, utility providers, and/or homeowner associations for violation of any law, ordinance, or rule during the confirmed stay, and any damages (which may exceed the amount of fines) that result from the violation. If any unauthorized download of copyrighted material via the Property’s Internet service occurs during the period of the stay, Guest agree that Owner may obtain and share Guest’s contact information with the internet service provider or any other party Owner believes, for any reason, has enforcement rights. •Eviction and Removal of Guest(s): If any Guest (Primary, authorized or unauthorized) or any other occupant is asked by the Owner (or booking agency representative) to vacate the property due to the violation of any terms, policies, and/or conditions found herein, the Primary Guest, in compliance with Texas Penal Code 30.05, will be given notice to vacate the property within one hour. The one-hour time limit will start when oral or written notification has been given or sent to the Primary Guest via phone call, voicemail, text message and/or email. If Guests fail to vacate the property within one hour, the Owner reserves the right to engage local authorities to forcefully remove the Primary Guest and all other authorized and/or unauthorized guests or occupants. •Choice of Law; Jurisdiction and Venue; Dispute Resolution. oChoice of Law. Unless otherwise specified in any Unit-Specific Terms or if a different choice of law is required by the law of the jurisdiction in which the Property is located: oAgreement to Arbitrate. Guest and the Owner mutually agree that any Claim will be settled by binding arbitration rather than in court, such arbitration to be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, or such other AAA arbitration rules that the AAA decides to be applicable to a specific dispute, that are in effect as of the time of service of an arbitration demand. Payment of filing, administration and arbitrator fees will be governed by the AAA's rules. To begin an arbitration, a party must send a letter to the other party requesting arbitration and describing the claim. If the Owner requests arbitration, it will send the letter to the Guest’s most recent email or physical address in the Guest’s booking records. If Guest requests arbitration, Guest must send the letter to Owner contact information given to Guest during the booking confirmation process. oPlace of Arbitration. The arbitration shall take place in the county in which the Property is located. oIndemnity. Guest, and all other guests, agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Owner shall not be responsible or liable for any reason whatsoever. Guest hereby covenants and agrees to indemnify and hold harmless Owner and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases. LIMITATIONS OF LIABILITY •TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE OWNER OF THE PROPERTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH THEIR GUEST OR OTHER OCCUPANTS STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF OWNER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
